Appearance Information

Misdemeanors, felonies and warrants require a court appearance. Prescheduled court appearances will be on the calendar. Advances and continuances may not be included. Report directly to the courtroom to which you have been assigned. Courtroom doors generally open at 8:30 a.m. If your name is not listed on the calendar and should be, report to the Clerk’s Office for additional information. Present the clerk with any paperwork you have that relates to your case. To appear in court on a non-calendared case, you must report to the Clerk’s Office by 8:30 a.m., Monday through Friday. Present the clerk with any relevant paperwork/information, such as case number, copy of citation, bail/bond receipt, driver’s license number and/or proof of compliance of a court order.

For courtroom appearances, the following rules are enforced:

• Shirt and shoes are required in the courtroom.

• Tank tops and T-shirts are NOT allowed in the courtroom.

• Food, drinks, and gum chewing are NOT allowed in the courtroom.

• Weapons are NOT allowed in the courthouse.

• Pagers and cell phones must be turned off.

Failure to Appear

If you fail to appear in court as promised/ordered, the court will order and issue a warrant for your arrest. Further, you may be punished by jail and/or a fine, regardless of the disposition of the original charge (Section 853.7 P.C. OR 1320 P.C.). In addition, the Department of Motor Vehicles may withhold issuance or renewal of your driver’s license and may revoke or suspend your driving privilege for Vehicle Code offenses. The prosecuting agency may also ask the court to add additional charges against you.

What do I do when I come to court, as indicated on my citation, cite-out letter, cash bail or bond receipt?

Look for your name, the courtroom location, and the time your case will be heard on the calendar usually posted in or outside the Clerk’s Office. If you are unable to find your name or locate a calendar, go to the Clerk’s Office.

How Should a Defendant Behave in Court?

• The defendant should dress professionally for all court appearances . Men should wear a suit and women should wear either a suit or a dress .

• The defendant should be pleasant and courteous to everyone they encounter in court, particularly all employees of the court.

• Inside the courtroom, the defendant should refrain from discussing his case with anyone but his attorney.

• The defendant should always stand when directly addressing the judge.

• The defendant should directly address the judge as “Your Honor.”

What do I bring to court?

• Bring any relevant paperwork having to do with your case, such as: Proper identification — Driver’s License, California ID Card, Social Security Card, or other picture identification.

• Name used when arrested (if different from current name).

• If cited, bring a copy of the citation.

• Letter from the prosecuting agency or court regarding appearance.

• Copy of bond or cash bail receipt.

• Jail release paperwork.

• Sentencing paperwork relating to your case; for example, the fine payment slip, community service contract, any paperwork received while in custody, etc

When appearing in the Clerk’s Office or courtroom, you must properly identify yourself

• Use the same name and spelling as listed on your paperwork.

• If the name on the paperwork is incorrect, please advise the Court.

• Be prepared to present a picture identification card.

How long should I plan to be in Court?

As a defendant, expect to be in Court for a substantial portion of the day to take care of all possible matters.
